Please note, no deposit will be accepted without an interview and a completed GR Puppy Contract. Checks and Money Orders are accepted for deposits or payments that will clear BEFORE the puppy is scheduled to go home, however, cash is required for final payments at pick-up or delivery. Sorry for the inconvenience, but the few dishonest who have walked away out of state or out of country with a free puppy always ruin it for everyone else.
Our contract has been duplicated whole or in part many times over the years, but copying our contract is not the same as copying our breeding program. _____ Due to the exceptional quality of our breeding program, Guardian Rottweilers always reserves the right of first choice and your pick will follow behind our pick(s). The order that you will be permitted to select your puppy will be determined by the date of your deposit. No puppy will be permitted for picking before sufficient age for basic character and conformation evaluation (usually 5-6 wks). When it is time to select your puppy, the breeder always reserves the right of final decision. *We have no way of guaranteeing the number or sex of puppies that will be available in a litter, however your deposit does not expire and does not restrict you to any particular puppy or litter.
What we expect from our Guardian Rottweiler puppy owners:
_____ If your puppy/dog is being sold with it’s tail intact (natural tail), Buyer agrees to leave the tail unaltered. Docking the tail without clear medical reason will be considered abuse/neglect by GR.
_____ The Buyer agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping this puppy/dog parasite free and up to date with inoculations, proper nutrition, and fresh water available at all times.
_____ The Buyer agrees not to take the puppy to any place frequented by other dogs or puppies until all vaccinations are completed due to the risk of contracting deadly diseases including Parvovirus. The Buyer further promises to complete all vaccinations in a timely manner. _____ Understand that your puppy will grow at a very rapid pace during the first 24 months. Buyer agrees to provide responsible care in regards to bones/ joints by providing professional, quality dog food and restricting harsh exercises (such as forced running, jumping higher than dog’s shoulder, care on stair cases, etc.) until the age of 12 months to help prevent hip dysplasia and joint dislocations.
_____ The Buyer promises to provide a safe environment for the dog, and never allow the dog to roam freely or be chained up/tied out without proper supervision. Your puppy will be microchipped by GR in order to facilitate his return if lost or stolen.
_____ The Buyer agrees that if this puppy is purchased with breeding rights, that it will not be bred before the age of 24 months and only be bred to Rottweilers with full registration, and that this dog and the dog it is bred with must have official certification of hips (OFA, Penn HIP, or equivalent), current Brucellosis blood test and up to date on all vaccinations and wormings. Should the dog be bred without the above qualifications met, GR will have the right to repossess the dog and all monies invested thus far by Buyer will be forfeited. If the animal in question is a bitch, GR may also repossess any offspring from the breeding in question.
_____ If this puppy is being sold as PET QUALITY the buyer agrees not to use this animal for breeding and agrees to have it spayed or neutered at the age recommended by your veterinarian.
_____ This dog is NOT to be used as a fighting dog. This is barbaric and torturous to the dog. Proper socializing is essential. “Over-socializing” will not compromise the dog’s ability to protect his family.
_____ If at any time the Buyer can no longer retain possession of this dog, Guardian Rottweilers is to be notified and given first option of resuming full ownership of dog in order to locate this dog a new home. Under NO CIRCUMSTANCES will this dog be sold, leased, traded or given away without the expressed consent of Guardian Rottweilers.
_____ The Buyer agrees to contact GR immediately if any questions or concerns arise about the dog, such as housing, diet, health or training. The Buyer agrees to keep GR informed of any treatment as it occurs. This provides Guardian Rottweilers with an opportunity to follow up on puppies and gives us important feedback and information on the health or our dogs for future generations.
What we promise as your breeder:
_____ WE ARE THE ONLY BREEDER I KNOW OF THAT OFFERS A TEMPERAMENT GUARANTEE. We are able to do this because of the quality of Rottweiler we breed, the bloodlines we use, the careful evaluation that goes into each and every breeding pair, and the early neurological stimulation, socialization and behavior evaluations given to each puppy both individually and as a litter. GR Guarantees the pup to be of sound mind and character at the time of sell. Breeding is only the first half of the equation in a dogs temperament and environment is the second half. It is nearly impossible to have a balanced dog without BOTH parts of this equation. We cannot stress how important the first 2 years are in forming the character of your dog. Good breeding is vital in providing a balanced base for you to start with, but your correct contribution is essential. It is your responsibility to properly train and socialize your dog from the time you receive it. Behavior, training, and socializing classes are always recommended, as well as any opportunity to expose the puppy to new experiences. The greater the variety of experiences as a puppy, the better adjusted he will be as an adult. Early intervention is also important. The sooner incorrect behavior is addressed the less time the puppy will have to “practice” incorrectly. It is much easier to correct behavior in a 10-20# puppy that it is in a 110# adult! Because of the profound impact the dogs environment will have on his character, we can only guarantee the dogs temperament for 30 days after the pup is sold. If, during that time, a licensed behavioral specialist concludes the dog to be of unsound mind, the pup may be returned for another puppy of equal value from the next available litter or a full credit of the purchase price (minus travel expenses) will be given towards a future puppy.
_____ GR guarantees this puppy/dog to be of sound health at the time of sale. A health record of all shots and wormings will be provided by Guardian Rottweilers. The Buyer agrees to take the dog to a licensed veterinarian of his choice within 72 hours for a physical examination and notify GR within 24 hours of any medical concerns. Failure to do so will void your health guarantee. At that vet visit, should your puppy be determined to be in ill health the cause of which is clearly attributable to GR, the dog may, upon signed written diagnosis from said veterinarian, be returned for another puppy of equal value from the next available litter. This does not cover common puppy parasites. Even though all GR pups are de-wormed regularly starting at 4 weeks, it is imperative that you keep your puppy/dog on a monthly heartworm preventative/de-wormer as puppies and dogs will inevitably come in contact with intestinal parasites through their environment. No other guarantees are given on PET quality pups. Although we truly wish it were possible, PLEASE UNDERSTAND THAT NO BREEDER CAN GUARANTEE THAT YOUR DOG WILL NEVER GET SICK OR DEVELOP A DISEASE. ALSO UNDERSTAND THAT NO BREEDER CAN GUARANTEE WHAT YOUR PUPPY WILL LOOK OR ACT LIKE AS AN ADULT. THE SINGLE GREATEST FACTOR IN DETERMINING THE BEHAVIOR OF YOUR DOG AS AN ADULT IS YOU.
_____ WE ARE THE ONLY BREEDER I KNOW OF THAT OFFERS A LIFETIME HEALTH AND CONFORMATION GUARANTEE ON SHOW QUALITY PUPS! If this puppy is being sold as SHOW QUALITY and it develops a genetic fault (a fault that can ONLY be inherited from the parents) which DISQUALIFIES it from the show ring, a free pup of equal value will be provided from the next available litter AND Buyer will be able to retain possession of original puppy. Proof of the genetic defect must be provided from either a licensed veterinarian or written proof that the puppy was dismissed from the show ring for a genetic fault. Complete contact information for the Judge/Kennel Club or veterinarian must be given. Proof from a licensed veterinarian that the dog was spayed/ neutered must also be provided. We will not take your best friend away from you simply because we failed to fulfill our end of the contract, we just ask that it be spayed or neutered to prevent the genetic flaw from being passed on and amplified in future generations. This clause DOES NOT cover size of the dog as the dog’s environment will be the greatest determining factor on the size/weight of the dog. GR Guarantees that SHOW QUALITY pups will receive a fair or better hip rating, however, the dog must be pre-limed at 12 months of age and x-rayed for certification before the dog is 30 months of age. Failure to provide proof that the puppy/dog was fed premium quality food (as listed on the GR NUTRITION page or agreed to by GR) will void your health guarantee. X-rays showing the dog to be dysplasitc must include the dogs microchip number scanned at the time of x-ray. GR reserves the right to have x-rays repeated or PENN hip performed by an orthopedic specialist at the Buyers expense. Any bite problems must be noted by your vet before bite work is started and hips and elbows must be pre-limed before any work is started. Breeding your puppy/dog before x-rays are performed or without following GR’s breeding policy (see next clause) will void your guarantee. The GR SHOW Guarantee ONLY covers GENETIC defects and not injuries, accidents or acts of God. GR always reserves the right to have any diagnosis reviewed by our vet at the Buyers expense. No monetary refunds will be given under any circumstances. GR agrees to replace applicable puppy with another puppy of equal value or the Buyer may elect to purchase a puppy of greater value and use the full amount paid to GR for the original puppy (minus any delivery charges) towards the new puppy price.
The Legal Stuff:
_____ If this is a replacement puppy, Buyer understands that, although the dog may come with FULL REGISTRATION and be permitted for showing and/or breeding, the puppy/dog will not have any guarantees other than those applicable to PET QUALITY pups.
_____ The contents of the GR Puppy Contract are only applicable to the Buyer named on the contract and the dog/puppy named in the contract, and is non-transferable. Any agreement between the Buyer and GR will cease immediately if the dog’s full or partial ownership is transferred to a third party or if the dog no longer resides with the Buyer.
_____ If the puppy/dog is ever found to be the victim of abuse or neglect, GR WILL ASSUME IMMEDIATE POSSESSION OF THE DOG AND WILL HAVE THE RIGHT TO PURSUE LEGAL ACTION. All monies invested in the dog thus far will be forfeited by the Buyer, and the Buyer agrees to be responsible for any and all legal expenses including, but not limited to, attorneys fees and court costs. The venue of any court proceedings will be held in Johnson County, Indiana.
Limit of Liability
_____ The Buyer agrees to release and hold harmless GR for any and all liabilities, damages, or injuries, caused either directly or indirectly by Puppy/Dog to any person, animal, whether actual or legal, or to any property whether real or personal. Furthermore, Buyer assumes full liability for any damages or injuries, whether physical or mental, emotional or economic, caused by Puppy/Dog, to any person, whether actual or legal, or to any property whether real or personal, after receiving and acknowledging delivery and possession of the Puppy/Dog. (In other words, once you get your puppy/dog it is your financial responsibility and if he eats your couch, we’re not buying you a new one.)
_____ Registration papers will either be given with the puppy or transferred to the Buyer immediately upon receipt from the AKC if they are still being processed. The registered name of your puppy will already be given by Guardian Rottweilers or the kennel of origin. If Buyer does not keep the name chosen by GR for the registered name, the GR Puppy Contract will be considered void. The Buyer is free to choose the “call name.”
_____ The puppy will not be released until payment is received in full. If the payment in full cannot be made by the time the puppy is ready to be released, a kennel fee of $100.00 per week will be added to purchase price. Any further vaccinations or vet care expenses will also be added to the purchase price of your puppy.
The preceding paragraphs contain conditions established to ensure the well being of the dog, but also to uphold and maintain the reputation of quality that Guardian Rottweilers has established over many years. The Buyer’s agreements will continue for the dog’s life and GR will have the right to enforce the agreements.
